Yes! CBN is legal! The 2018 Farm Bill amended the American Agricultural Marketing Act of 1946 and added a definition for hemp as an agricultural commodity. The 2018 Farm Bill defines raw hemp as an agricultural commodity, alongside corn and wheat. CBN oil is legal in the United States as long as it is derived from hemp and contains less than 0.3% THC. Hemp is expressly excluded from treatment as “marijuana” under the federal Controlled Substances Act (“CSA”). This means hemp is not, and cannot be considered, a controlled substance under federal law. U.S. Drug Enforcement Administration (“DEA”) also does not maintain any authority over hemp.
